I'm no "authority" but we have one member of our company who's SOLE job 24/7 is to research Canadian obscenity laws, precidents, etc etc etc. Believe me, we keep this boy busy. Just because those models signed a paper doesn't mean they were willing... if they were pressured in ANY way (even a Hey baby sign the paper will ya?), it will be considered duress (especially if they are trying to take these guys down) and any contracts/releases they signed will be invalidated by the courts. As well, if there were any drugs or alcohol involved, this can also be construed as duress, and will automatically invalidate any paperwork.

As far as what is considered obscenity in a community... You have to look at the definition of "community", and there are several factors that will affect which definition of "community" is used in a legal sense. It really depends on how badly the law wants to take these guys out. Community could be the country, it could be the city, it could be the area of operations, it could be the two block radius around their studio. If some little old lady a block away said what their stuff did was "obscene", Tada, you are offending the local sense of what is right, therefore going contrary to the "community" viewpoint of what is obscene. Doesn't take much to get busted if you aren't careful, and I get the impression these guys weren't the most quiet of neighbours. All it takes is one person making a stink and you can get into trouble. Just because they broadcast porn on cable tv and satelite doesn't mean that a "community" will accept it. I would LOVE to shoot where I live, but I would get completely slammed with obscenity because I live in a small, VERY VERY religious community, who think living with someone you aren't married to is a mortal sin andall who do it should be publically stoned. However, I drive three hours south to Toronto, and I am fine by most community standards.

The law is NOT cut and dried, a LOT is left to the interpretation of the courts, and therein lies the pitfalls. You have to keep your nose pretty squeaky clean and maybe you can get away with a little more... but these guys are likely going to go down very hard, and the reprecussions will be felt in the entire adult industry, not just Canada.

These guys broke FEDERAL laws first, Provincial Laws second. It wouldn't surprise me if this were taken to a federal level to ensure maximum penalties. It's going to be ugly all around, and it's DEFINITELY a bad reflection on the adult entertainment industry as a whole. Just what we all need! Ugh!

Mr. Steve Sweet, President of Sweet Entertainment Group (SEG), and 3 other principals of the Corporation were charged on December 6, 2002 with 6 counts of obscenity based on 3 specific videos from the SadoSlaves.com Library.

SEG has not been charged with any criminal offense. Mr. Sweet has not been detained in this matter.

The Crown has alleged that Lexa Lords, Naughty Nikki and Mistress Twilight sadoslaves.com video episodes are obscene pursuant to s. 163 of the Criminal Code of Canada. Three counts allege that the accused "did make, distribute and circulate an obscene video" and three counts allege "did have in their possession for the purpose of publication, distribution and circulation, an obscene video."

It appears that the Crown is concentrating its efforts on the BDSM subculture by alleging that the material in question combines explicit sex with violence or torture or that the material is degrading and dehumanizing. The Crown has not to date provided particulars of what segment of the videos it regards as being obscene.

The charges stem from Vancouver Police Department raids on the premises of Sweet Entertainment Group that occurred on March 13, 2002 and second raid that occurred November 7, 2002.

A number of pre-charge applications and motions to Court have already been successfully brought by SEG resulting in Orders from both the Supreme Court of British Columbia and the Provincial Court of British Columbia for the return of SEG property.

The most recent decision from the Supreme Court of Canada regarding obscenity is a 1992 decision Regina v. Butler. Much has changed in the past 10 years, with the explosion of the Internet, the commercial availability of BDSM type content and the shift of community standards this past decade. Mr. Sweet has indicated that SEG will vigorously defend the charges. The case is far from trial and many matters remain to be dealt with. Of course, should the matter reach trial constitutional arguments regarding Freedom of Speech under the Canadian Charter of Rights and Freedoms will be at the forefront of what will likely prove to be a precedent setting case.

The maximum penalty under Canadian law for this offence is 2 years. A conviction generally results in a fine.

SEG will continue to provide cutting edge content to its many customers and carry on its operations as it rises to meet this legal challenge.

From seeing things happen in the porn industry over the years, I'd say when it starts to drizzle there is usually a rain storm getting near.

I would highly recommend to any webmaster who looks at what they publish on their sites and has any doubt in their mind about whether particular content is over the edge and pushing the limits or not, to do yourself a big favor and tone it down. You'll sleep a lot better at night, and if taking it off your site costs you a few signups that certainly is better than shelling out tens or hundreds of thousands of dollars in legal fees should the worst case scenario ever happen to you.

Porn has always been a risky business. Even Hef was arrested once on obscenity charges and that's incredible considering the total and complete softcore porn Playboy publishes.

Its all about visibility also. The bigger you are in the market, the greater the likelihood that one day there will be a knock on your door if you are displaying extremely past the limits hardcore content.

Most guys who get indicted get off fairly light in terms of doing any serious time, and the majority just take it up the ass in legal fees, and court fines, and having their business decimated after the raid when they get all their computers seized. So usually even the worst case isn't totally the end of your career. But its simply crazy to hang your ass out on the limb everyday when you don't have to. There is plenty of money to be made on the safe side of the fence so why chance it.

Anyone who knows Steve Sweet should know that he is about as smart as they come, he has a kick ass legal team and I doubt that he is very worried. Obscenity is one of the hardest things yo be found guilty of in court.

Max Hardcore just got off an obscenity charge here in Los Angeles about 2 months ago. It was 2 years in the making, and they could not prove there case. It was let go due to a hung jury.

This does nothing but brings a lot of publicity to the Sweets, and i'm sure they will keep on going like nothing ever happened.


As far as the Max Hardcore rape case, that was a couple years ago, some whore which was shot a few times before claimed she was raped, the police got involved but, nothing ever came out of it and the charges were dropped. The funny thing about that is the whore actually came back a few months later and shot 2 more scenes with Max. Just goes to show ya most chicks in the biz have mental issues and at the end of the day it's about the $$$. But, I can say there are a lot of smart women in the industry as well. So who knows.
