Alcohol and drugs are not an excuse ? or an alibi. The key questions are :
-Did both participants AGREE to take part?
-Did both people have THE CAPACITY to consent?
and how old are you and the other person ?
you should give more details, because it could be or not a rape depending of the exact situation.
