If the one being "raped" is too out of it to say no, then yes, it is rape.

i think one should take into account the physical difference in the genders, which to me complicates the idea of personal responsibility because, in most cases, a woman cannot stop a man from taking her. there is no female-to-male type of equivalent crime. Not sure what the laws are if the person is drunk. I find the behavior a bit predatory, but I don't know if I would go as far as calling it rape. As long as they are not directly involved with their intoxication, e.g. dropped pill into drink, then I can't see how they can be arrested for rape. It's morally wrong, but as long as the girl can walk or talk, there's implied consent. If she's passed out...yeah, that's not only illegal, it's pretty fucking creepy.
