As far as I remember from my days at Gonzoga Law School, it is strictly a term that was used in Sony's defense against their Universal/Disney suit back in the 80's. It is not a legal precedent.
Read the thread. I posted it.

Take-aways from this thread:

1. Program owners need to treat affiliates better because they are there to help make more money.

2. Affiliates need to respect program rules and clarify terms when necessary or get special considerations in writing first.

3. Will76 is reborn as the champion of the downtrodden and disgusted.

4. When pissing matches start it is wise to stay upwind lest you get wet.

Well, the new TOS is nuice I guess. Deleted my 4 ITC posts as they were still in violation. I will still promote ITC with banners and FHG's but as far as using them on my blogs, fuck it. I tried dropping some knowledge but in the end you own the content.

At least the TOS states the details now. Mission accomplished???

That's actually a very easy thing to do, but I doubt most do it. I like to do some different things with content and always ask first. For the most part the answer is always yes you can, and if it's not, no hard feelings either way. They do appreciate the contact though and who knows, they may make a note of it so if another employee comes across one of my sites they'll know that it's an approved use. If they don't know that, I can forward the email or ICQ conversation I had since both are archived by me forever.

Here is what I take from this thread:

1. If you are in this business 100% to make money it is sometimes hard to deal with people who's primary reason for being in this industry is because of their "passion" or "lifestyle".

2. Photographers typically don't make good affiliate program owners as they have no clue how affiliates work, or even how to work with them.

3. Some times being anal over little things can cost you 10x more money in the long run.

4. That guy Will76 is an asshole.

5. You post on GFY you will get hate mail. That's right I got my first insulting email in 8+ years being here, from an anon person because of this thread. How sad is that, that people have to take the time to make a fake email address and send you insults and they are too pussy to stand behind their words.

No. I saw it but pretended to ignore it because when the moon is full I still have to chain her down to prevent her from shapeshifting into the she-wolf and howling for you...

Damn you and your cross selling!

Next time I am betting on black...

Not going to lie. Speaking as a program owner the world needs more affiliates that think like that. Affiliates need to stand in program owner shoes and owners need to feel what it is like to be an affiliate.

Some of the best programs out there were started by the "whale" affiliates of days gone by. They do know how to make affiliates happy. But not all progs come from that background and that doesn't necessarily make them bad progs. Obviously, ITC has a good product and sells well in its niche and should by all accounts be good to work with... however one mismanaged aff rep that treats an affiliate like crap can really screw stuff up and bring a fiery shitstorm of hate on the program - and owners have to take responsibility for that.

Affiliates need to realize that programs do their best to accommodate everyone but let's face it, there are those that expect the world but have never sent a sale and probably never will so it is hard for proggies to bend over backwards for them. Unfortunately, those are the ones that make the most noise and cause the most stress because they bring their problems to places like GFY and get all jihad on the program. So programs spend inordinate time and resources to quell those strident bomb throwing burn the house down anarchist affiliates...

But the best thing would be to do what you do - actually communicate and work together for the best possible outcome.

And that is not just the Deadhead hippie in me saying that but the pragmatist businessman too...
