SAS (software as a service) and custom extensions are both ways to deal with piracy issue

No they should not pay a fee. However, if it is fraudulent and the DMCA is uncontested, the sender should be fined a very large amount, per DMCA.

Sending a false DMCA should be a felony punishable by a very large fine and jail time for repeat offenders.
