In the kids play area, you watch them, but dont need to stare at them intently because they are enclosed in a supposed safe area. Best to not take your kids to Mcdonalds, but i understand her reasoning. Watching two kids at the same time at that age is a very very hard job. Mcdonalds playground is like a break for her, she can relax and just sit while they play.
I refuse to go there it is better to go to the pay to play ones, because then you can interact with your kids, and you are forced to watch them more closely.

Ugh....if true, imagine the horror she is going through.

Fuck mcdonalds they have an army of staff to keep the place clean, and seems they are not doing their job.

On the other hand, it wouldnt shock me if it was a lie. The camera will tell the story.

The general rule in Illinois is that the burden is on the plaintiff to prove that the management or its employees placed it on the floor, knew about the object and did nothing about it, or that it was on the floor for so long that it reasonably should have known that it was present and removed it. It will be nearly impossible for plaintiff to establish that an employee placed it there or that it was on the floor for a long time. If she testifies that she knew that it was on the floor for fifteen or twenty minutes, she has a hard time explaining why she permitted her child to eat it. In fact, some kid may have emptied it out of pocket, maybe wrapped in kleenex, only a moment before. It's a tough position for a plaintiff, and unless McDonald's decides to settle it quickly for nuisance value now to end the publicity - and they do not have a reputation for caving in because it makes them a target to cave in - the likely result is summary judgment for the defendant, a judgment for McDonalds.

In a former legal lifetime, I spent ten years working for an insurance company, representing its insureds. Getting summary judgment for our corporate clients on debris, foreign matter and liquids on the floor was almost routine. Very tough for a plaintiff to win these cases in Illinois.
