Nearly 95 percent of e-mail is junk: US Web security firm

Nearly 95 percent of the e-mail sent in 2007 has been "spam," junk advertising loathed by its recipients, according to a report released Wednesday by a US Web security firm.

The amount of junk e-mail has skyrocketed despite a 2004 US CAN-SPAM Act that placed restrictions on sending unwanted messages and sanctioned penalties for "spammers," according to California-based Barracuda Networks Inc.

Of course it fucking did. What moron expected it to have any other effect? It legalized spamming as long as you started the subject with the proper designator, let them opt out and don't forge the headers. Then you can fucking spam all you want.

People were finally starting to get ahead on the spam issue by suing under the state statutes to shut the mother fuckers down, and then that god damned good for nothing, ain't worth a shit CAN-SPAM law came along.

I have a stack of nearly $300k worth of default judgments here from suits I filed that I probably wont collect on, but I have already collected on a few and they were enough to make it all worthwhile, and I know for a fact I was personally responsible for closing up one spammer's little operation when the court ordered the sheriff to lock his office and auction his assets to satisfy my judgment and I am sure other people that were in the same circle working in their own areas shut some down as well.

Right when plaintiffs were finally starting to make headway, the fucking Congress - at the urging of fucking businesses who were upset that they might not be able to spam anymore and the god damned Chambers of Commerce and NFIB - started with this CAN-SPAM bullshit which they disguised as a consumer protection law when all it did was preempt the state laws that were allowing advocates to make headway and make it so only ISPs and a couple of classes of entities - but not end users - could sue.

After CAN-SPAM, no one is a target except for the very biggest outfits. No one goes after the small guys because activists cant do it anymore and Microsoft and AOL have to pay their attorneys and its not worth it for them to go after people working out of their basements so they don't. But because I did my own lawyering, filed my own papers, it was well worth it for me to file on a case that would bring in under $10,000.00 if I thought there were any assets I could get at because filing fees were only $150 and service another $150 (or $50 grand total if Small Claims) and that was about the extent of my expenses to bring a suit. And most of the spam comes today from people working out of basements. Most of the time they don't even show up and when they did they never had a decent defense.

Hell, I remember the attorney (who was supposedly one of the best in town) who was hired to represent a spammer I filed on, when he showed up, his main defense was the fact that "Your honor, the Plaintiff has filed more than ten lawsuits this week alone and over a hundred this year...", which while true was just a ridiculous defense. When I objected for relevance and the testimony was stricken, he rested his case, I moved for summary judgment and that was the end of that.

Spammers are absolute parasites. If I had my way, I'd have them all burned at the stake. But since I am not going to get that wish granted, I'd like to at least be able to sue them and have their assets sold and liens put on their real property and I'd be happy. But no, the FUCKING CAN-SPAM ACT took that ability away.

GOD I HATE SPAMMERS.
