I think flashcash is ok,

but how is it legal to take screen shots of monster's ball?

I don't understand that... and about 10 other movies as well.

Surely the distributor doesn't allow screen shots to be sold to subscribers?

The problem is that Ibill are worried, they are worried some celeb includes them in a legal suit. They have money and are worth linking to you in a case.

Plus they are worried that if this gets back to Visa and blows up it makes them look bad.

Let's face it the Internet is changing and this is part of it. It will not happen over night but it's on the way.

What I have heard is that it has to do with laws regarding using the content for the purpose of review. For another example, think of video game sites taking screenshots of video games to review them.

I don't know if that is actually true, but I have seen a lot of people argue that point as being true.

Saying the people downloading mp3's for their own use is the same as selling content not licensed to you is insane. Now if I downloaded mp3's and burned them on cd and sold them then it would be the same thing. There is no comparing, its people that sell memberships to content they dont have a license give us all a bad name. I am not judging but some of us must be right when no third party processor wants to touch him, must say something.

You're probably right about that. What pisses me off is that the copyright holders themselves, the only ones with real legal recourse, are not going after celebrity sites. It's the celebrities themselves, who have no legal right to the pictures, who are doing the harassing. Because it's cheaper to shut down the celebrity sites than it is to hire lawyers to fight the cases, the processors just bend over and fuck us.

Those of you who produce content, think of it like this - you have your models sign releases so that YOU own the pictures. There's nothing wrong with YOU going after infringers, but think how pissed you'd be if the models starting making bogus claims to owning YOUR content. That's what's happening here.

Even if you wouldn't think of dealing with celebrity content, realize this - it's just a matter of time before some group or governmental agency starts threatening lawsuits over what they deem "obscene" content, and a lot of you will be up shit's creek even though they don't have a valid legal claim. You think iBill is going to spend hundreds of thousands of dollars defending people that sell S&M content? Young teen content? Bullshit. VISA is already sticking their nose in our business these days - don't think for a second that when the shit hits the fan they'll just pull the plug on what is really a very minor portion of their business.

So, back on topic, what processor should I go with?

I suppose the RIAA shutting down free file sharing networks, free CD cover archives and threatening Universities and the US military academies with lawsuits isn't the same thing then? Bullshit. They don't care, it's still a violation of copyright law.

Again though, I'm not arguing that the movie studios and magazines don't have the right to enforce their copyrights - legally, they do. Problem is, they're not doing this, the celebrities themselves are using intimidation techniques to scare processors into shutting down the sites when they have NO LEGAL RIGHT to do so. It's a nasty trend, and people should be fucking outraged over it, because one of these days the same technique is going to be used against everyone.

I don't know why I bother to keep saying this shit.

I can tell you who is behing the whole thing. I have been dealing with the celeb issue behing the scenes for some time now. Perfect 10 is the one sending out all of the lawsuits.
They are the ones that caused adultcheck.com to pull all the celeb sites and are the ones suing Ibill and CCbill both.
So if you want somebody to rant and rave at turn your frustration to http://www.perfect10.com

#1: Open Notepad

#2: Find typical licensing agreement legalese on Google

#3: Cut & paste legalese into notepad

#4: Insert relevant domain name + celeb name(s)

#5: Send to IBill

Very likely they are just looking for something to cover their own asses with, otherwise known as plausible deniability. If it doesn't work, you're in no worse shape than you were before.

So I've heard as well. I wonder if Zadeh will actually produce a list of images that are in violation or if he's just hoping that his deep pockets will wear down the defendants.

You cannot cry copyright infringement on things you do not own the copyright to.

If I see pimpdogg breaking the fuck in your house and stealing shit, I can call the cops -- it is a criminal matter --

If I see pimpdogg using someones content and I know he didn't pay, I can't call the internet police or even fill out a DMCA on the owners behalf. All I can do is tell the owner and if he's not interested in pursuing it, that's all there is to it.
