Mother whose son was killed by drunk driver charged with manslaughter

So she gets off of a bus, and is jaywalking.. why? Because she doesn't want to go all the way up a long block through some dark scary shit and then all the way back down that same long block.. to get her kids home.

i feel for her sure...but teaching her kids to jaywalk is stupid
but here is an example i witnessed just yesterday

a father mother and two kids, one walking and one in a stroller...decided to cross...at the cross walk even, but they decided they had enough time to cross when it wasnt there turn.
so they start out, and then realise they are now standing in front of oncoming traffic.
they then have to run from oncoming cars...sure people are slowing down for them.
but their kid just learned it is ok to step out in front of oncoming cars

I see the article says the locals think you should just walk however far it is, so I guess they figure everything is just fine. All fair and balanced. 6 months for the killer, 2 years for the grieving mom. What a great place to live and raise a family.

When you cross the road the driver has a responsibility to stop and/or avoid hitting you.

By the same token you, as a pedestrian, have a responsibility to cross at a cross walk, and not in the middle of a busy street.

I think the drunk driver should have definitely gotten more. Both him and the mother contributed, although one was clearly doing more wrong than the other.

In Canada there are to guys that are getting 6 months house arrest for vehicular manslaughter of two women. They had been racing on city streets and caused a 7 car accident that lead to the deaths.

6 months house arrest? For the love of god.

Ok i am sorry i do not agree with most people. Who's to say him being drunk caused the accident? no you shouldnt drive drunk. but if someone is J walking on a busy road where you dont expect pedestrians then there is no way to prove being drunk caused the deaths.

every fucking person on the road is hopped up on caffeine, high on meds, tired etc etc. its just how it is.

it was her actions that caused it. prove to me him being drunk caused it and we have a different story. it was 100% her fault.

There we go. Unpopular but the truth. The driver didn't hit them on the sidewalk did he? If that woman had not crossed the street that "drunk" driver would have driven right on by. The mother caused everything by not using the common sense adults are supposed to have.

Really, who the hell can't judge if it's safe to cross a street? But jail, no way she is suffering enough.

I agree, and I'm sure she was convicted because witnesses showed she was negligent by allowing her kids to dart out in the middle of traffic. Also, the thread title is not accurate, nowhere does it say the guy was "drunk". He admitted to having had drinks and being on medication the night of the incident, but because he fled the scene there's no way to know what his blood alcohol level was.

As a parent I can't imagine trying to cross a busy street and not restraining my child by holding their hand and crossing with them and certainly not crossing outside the crosswalk. She allows her first child to dart across the road without her, then watches as her second child follows shortly after and gets killed, you would have thought she would have at least restrained the second one before he ran out.

Last time I was in LA I got a jaywalking ticket in downtown LA at like 10pm while loading some gear into my jeep. My friend got one too. The police said we would be mailed a ticket, how much to pay and all of that.

Mine never came.

So I asked my friend if he got his, he said yes, it was a little over $100 and he paid it. I called whatever department at the time I had to call and they informed me that it was "optional" to actually mail anything to me and that I missed the pay date and I now owe the city $1000 and some change. For walking across the street, on an empty downtown street, at 10pm, and doing so not on the designated walking area which was about 20 feet from where I was actually walking.

Go figure. I can see why we're hated for our freedoms.

I found out about it like a week before I was leaving the country and I was closing up all of my USA loose ends. I told them I was leaving and would be more than happy to pay the original fine, or even double, but I wasn't paying $1000 and come next week I would be out of the country and they wouldn't get shit. They didn't budge. I left.

I've since checked to make sure I don't have a warrant on me and I don't, so piss on them and their $1000 jaywalking ticket.

I feel sorry for the mom for this reason :

People from smaller cities have absolutely no training in crossing the street
or walking in the street.

I know this to be a fact because I grew up in a small city and looked like a
fool as a pedestrian when I moved to LA.

I got a jay walking ticket within my first month.



People who live in the suburbs have to drive everywhere to do shopping, school and
work, because nothing is in walking distance of their homes.
They have very little experience walking in traffic.

This is actually taught in the schools, but where is the practice?

I'd have to agree as well. We don't know all of the story as the press is notorious at doing this to create the 'buzz" they need. What I DO see here are two separate crimes and treated as such. Yes, drinking and driving is bad and even though we all do, we also all know it's bad and most wished we hadn't latter. But who is to say whether or not this child could have been saved if he had not been drinking.

But then again, there is the part of responsible parenting. You put your child in harm, even if that harm is someone acting outside the law, you still put your chile in harms way. In the end, could this child have been saved by not walking through traffic?

Just saw on TV the the Judge in the Mom's case decided to give leniency and gave the Mom a choice at her sentencing.

She was given the choice of being convicted and serving six months of probation and performing community service OR having a retrial. The Judge gave her a week to give her decision.

So she got a new Lawyer and appeared on the Today Show this morning to announce that she will go to court again and prove her innocence. Keep in mind she was going to be sentenced something like three years in prison so she is taking a big risk.

Perhaps she thinks she will get a reality show or People Magazine cover
