IS DMCA effective against content piracy?

Not sure if this was previously discussed on another thread but I just want to hear your thoughts on this topic. I'm still familiarizing with the details of protecting one's work against piracy and I would appreciate you sharing your experiences, thoughts, and such.

Also is there another way other than takedown request via DMCA? Thank you so much!

Its only effective if the copyright owner knows about the infringement (1st important point) and if he takes action (thats the 2nd)

I am dealing with this almost daily.

To your question: " is there another way?" My experience is no, unless you have a relative from the Corleone family and give them an offer they cannot refuse, or see my comment in 3) below regarding Federal judgement.

To your question : Is it effective? My answer is yes, but with following caveats.

1) you need to have a proper takedown notice with ALL DCMA required info.

2) the site can be anywhere ( even in Russia) as long as the hosting company/ server is in USA or EU. They usually do not respond to the first take down notice, but once the hosting company is cc'd its gone the next day and on the next pass ( new pirated content) its usually quick. We have actually converted a couple of pirates into Affiliates.

3) unfortunately the biggest pirates in the world are ( and in this order): Amazon, E Bay and Youtube.... They ask for a Federal judgement or similar crap. Now tell me who out of adult producers can hire a law firm in Delaware to issue an injunction only to be appealed? Can you "spell" several 100's of thousand dollars per case?

A) with Amazon we threaten the suppliers to the Amazon retailers usually with 50/50 success/ failure rate.

B) E Bay ditto as Amazon

C) Youtube? No luck with their DMCA department, they will find an error with your form 1000x over, but just report the video to their "morality policing" department that the video exploits / insults women, African Americans, Jews etc....and its gone the next day...

There is not much you can do about PayPal/Ebay Washington DC likes them, there are retribution alternatives though.

I think you know as well a I do the legal system's protection for you will not be inexpensive or swift if even just.

Completely agree, when I tried to file about three years ago against an Amazon merchant ( Amazon was only listed as co conspirator) a copyright law firm in NY asked for $ 30,000 retainer and did not promise anything more then filling and attending the first hearing. The estimate with all of the potential appeals was over $ 500,000 ....Of course I have dropped it.

... I think a class action suit by ALL webmasters each chipping in a couple of grand is the ONLY way to fight these new Al Capones.

You can not fight Big Boys or hackers / content theft. You need to attack it at the heart with bad ass tactics. Think like a criminal and live like a king. Porn content theft is big business. Think Mindgeek. Ok enough. I have several threads on how I do this and a few secret sauce strategies that actually pay off.
