I would agree with you if he were a resident of Iran, but the article says he is a permanent resident of Canada, at least according to his family. The article does not say what he was doing in Iran at the time of his arrest.

You didn't read the article did you? It said he wrote a photo upload script that was later used by a porn site with out his knowledge. It wasn't him running a porn site but someone used his software to run one.
