Legal advice how would you address this email (legal)

I run an escort site and I received an email to say that an ad on my site had the wrong phone number this is the email

She has received numerous phone calls and texts from your prospective clients requesting services.

In addition to this, I request that you forward written apology to my daughter via my email address for this trespass on her privacy, dignity and innocence.

Failure to comply with the above request within 24 hours will leave me with no option but to contact my legal representation in regards to fair damages and compensation.

Ignore, or reply that you believe it was a boyfriend of her daughter's that created the ad and replied to the confirmation (if you have such a thing as she mentioned in her 2nd email).

If I replied it all, it would only say that just like a paper newspaper isn't responsible for the accuracy of classified ads you cannot guarantee the activity of every ad placed.

The request for compensation is fishy, but on the other hand I see no need to be rude and stir the pot. If it really is an angry mom, getting her more angry can do no good.

Legally, I think it's questionable. Newspapers do exercise some editorial control, but more importantly some escort ad sites have had legal trouble so there's no need to encourage someone to call the cops or DA. Even in the cases where the escort site "won" a legal battle it wasn't a pleasant experience.

PS - The to get an appropriate attorney is six months BEFORE you open an escort site. Pandering carries real jail time.

im fairly sure it is a real mom as her email address is for a local 10-15 yo soccer club

The ad on my site is from the news paper they confirm they want there ad on my website. All electronic submission are called back by me personally to confirm the number.

Take your pick, but some of these wannabe scammers can be very convincing, not like that Lawrence Connor idiot pretending to be a priest.

Hindsight is a bitch, but you should've kept your mouth shut from the start.

Either way it sounds like someone is just desperate for a fight... there's nothing you can say or do to convince idiots like that. Sounds like you have measures in place to prevent mistakes/malicious users, and as for being personally responsible...

If I were you I wouldn't be placing ANY prostitution related ad on your site that wasn't directly submitted by someone to your site. Copying ads from the newspaper is just asking for trouble. Given the current climate regarding this kind of thing in Western Australia, I'd be particularly careful about this stuff.

To me this seems like an innocent mistake and a mom who sees it as a way to make a few quick dollars. She is likely one of those people who demands free food if her order gets mixed up at a restaurant.

Is she going to sue you? Likely no. That would cost money and really, what kind of damages could she hope to get? She would have to put her kid on the stand and prove that getting these calls damaged her and, as you said, it was a mistake. You didn't do it on purpose.

People who are going to sue normally just do it, they don't threaten you with it.

I would be tempted to ask her how much she thinks is fair compensation. When she sends you a number you get a lawyer to send her a letter via certified mail basically telling her to stop trying to blackmail you and explain that you have fixed the mistake, but you aren't paying her. Tell her if she if she continues to attempt to extort you that you will turn her into the authorities. She will shit her pants.

The problem for the OP is that the ad wasn't submitted to his website, he's copied it out of the newspaper. Effectively publishing the phone number of a 15 year old girl in relation to "massage" services due to the mistake of another publisher.

Notwithstanding the fact that the original ad is plagiarized, the risk of copying ads from third parties in relation to sexual services has just been amply demonstrated to the OP.

I wouldn't be putting ANYTHING on the website that wasn't directly submitted because you lose the ability to say it was user submitted and you took reasonable steps to confirm the ad.

If you're going to accept ads for adult services I would suggest email verification at the minimum with captcha.

www.cracker.com.au have most of this market and they'd have better legal advice than you have at your disposal, what do they do to verify ads ?

Most of the ads are for friends that i have put on there but for the user submitted i normally call them or send an sms. With cracker,beautifulcompanions i have advertised on there before with only email conformation were as the news paper calls me to confirm. So do you think i should dump that site and start again with only user submitted on a new domain?

What you do is up to you, however I'd be getting legal advice on structure/dos and don'ts before running any kind of prostitution promotion service.

I don't think it's prudent to be copying ads from other sources, newspapers or websites. I'd also have email confirmation as a bare minimum.

That part in bold - big red flag right there! Wow, they're looking for money...

As many others have already said, likely best to, NOT reply back. Ignore any further correspondence.

In the future, consider verifying all phone numbers - lots of ways of doing that, including various automated services (legally, likely the safer route verses manually doing it; maintains consistency and to avoid any conversation that could be used against one later) that calls the phone number and provides a verification code to enter in on a website, etc.

The funny thing is the ad has been on the site since September last year with only 4 page views which she claims numerous phone calls and texts

Depends around $5-$50 per month for ads but i get a few calls from the site. Which is better than paying the paper or another website.
