I'll be the first to admit I advertise girls as "online" that probably aren't online. Plenty people use fake chat promos, the fake im box pop ups, or saying someone is in your city but they are not. 95% of us probably do some or all of that.

So... when I read this it made me think, would be fucked if Attorney generals ever went after porn / online sites? Almost everyday I get hit with some pop up from a site saying I am A WINNER!!! when you know i didn't win shit.

According to the lawsuit, Smart Automotive sale ads falsely used terms such as “Seized and Repossessed Vehicle Event,” “Statewide Used Vehicle Liquidation,” “Emergency Disposal Event,” and other deceptive and misleading terms that were not true.

Smart Automotive Group sold promotional advertising and sales packages to Iowa auto dealers to increase sales of the dealers’ used vehicles, the suit said. Such packages “are designed to trick consumers into believing the vehicles come from a source other than the dealer’s usual used vehicle inventory and are available at lower than usual retail prices,” the suit said. Miller called the practice “false-premise” deceptive advertising.

“The problem is that such ads mislead customers into thinking vehicles must be sold quickly and at bargain prices, when that is not the case,” Miller said. “Consumers are misled, and sometimes they end up paying prices that are even higher than normal.”

The suit also alleged Smart Automotive Group used other misleading ads or tactics, such as scratch-off prize cards, as “a subterfuge designed to trick consumers into visiting the dealership,” subjecting consumers to undesired sales pitches.

The suit also said Smart Automotive sometimes sent in sales teams who “use high-pressure sales tactics to sell consumers vehicles under false pretenses.”

The suit was filed Friday morning in Polk County District Court in Des Moines. It asks the court to order civil penalties up to $40,000 per violation of the Consumer Fraud Act, order restitution for consumers, and prohibit future violations.

Defendants named in the lawsuit are Smart Automotive Group, LLC, located at 1329 Gardenia Drive, Metairie, LA, and Bernard E. Burst III of New Orleans, President of Smart Automotive Group.

so.... when we advertise someone as being in their town, they signup and that person is not. Is that any different (or worse) than saying this car has been repo'ed this price is rock bottom and it is just a car off the lot with normal pricing?

Well...I think that if a government agency really got serious about the false advertising/practices on porn sites the over whelming majority would be in serious trouble.

deceptive ads are everywhere, i have always had a hard time figuring out where the line lays as well as it ISN'T very clear.

Every burger ad is a lie and obviously deceptive.

I have heard it described as how the consumer interprets the deception. When you see a travel ad you realise you are not going to have the EXACT same experience as the people on the pristine beach sipping cocktails

you will never get this burger in any burger king , yet it is what they are offering.

almost all businesses engage in false advertising to some degree. it's luck of the draw if you get singled out. our next door neighbor when i was a teenager was a diamond dealer, he got charged with deceptive advertising, the court case seemed to last forever.

the one i fucking hate is the retailers who advertisers that WE PAY THE TAX!!! and in tiny print at the bottom they say 'prices have been reduced blah blah blah prior to taxes making the equivalent etc etc'
