Diane Tran, Honor Student At Texas High School, Jailed For Missing School

Diane Tran, a 17-year-old honor student in Texas, was forced to spend the night in jail last week after missing too many classes, KHOU-11's Sherry Williams reports.

The Willis High School junior, who helps support two siblings, has both a full time and part-time job. She said that she's often too tired to go to school.

"She goes from job to job from school," Devin Hill, one of Tran's classmates, told KHOU-11. "She stays up until 7:00 in the morning doing her homework."

What in the FUCK is wrong with people now days.

Did you read what I posted? How can you NOT have a problem with this. They put an honor roll student in jail for 1 night based on the fact that she missed tooo many days from school??

You do realize that once a person no matter the age has been " Arrested " and spent any amount of time in jail, they will NEVER get that out of their past and it can prevent her from going to the best of Universities and going further in life.

That is a MAJOR fuck up on the part of the judge and the system.

there are labor laws that are supposed to protect a child from working that many hours so that she would not have to miss school because she is exhausted. However, her obvious need for money with helping to raise her two siblings means that law would actually hurt her instead of helping.

Of course the authorities went about it the wrong way, sitting her in jail for truancy. But in the US helping her or her family would be considered welfare and she would be exploiting 'entitlement programs' which require taxes to pay for them. Here in the US people will be shocked and outraged that an honor roll student was jailed for missing school but slam the door fast and lose all sympathy if their taxes would go up 1% to help her, her family and millions more just like them.

I remember those days. The college I went to was a full dress code mandatory attendance school. Miss three days in one quarter and you were kicked out. Combined with a full time job it was brutal.

Did the same thing to me even though I had mostly A's.

I believe they get funded partially based on occupancy, so whenever a student misses class it costs them money. That is the only reason they give a shit.

Most...if not all public schools...are funded based upon attendance...that is the primary reason they demand attendance.

This is ridiculous of course, however i dont expect anything less.

In high School i had high marks, and tutored other students in math.
So when i missed as many classes as i wanted, no one even cared. My teachers sure didnt care, what did they want me putting my hand up in class to catch their mistake on the board? lol

I found the teachers generally didn't care in the past, but the principal definitely wanted you there so he didn't have to cut programs or services at the school.

I find these days the teachers are being forced to be even more strict on the students with poor attendance. I had prepaid close to $3000 for a school trip for my daughter to go to a few countries in Europe and about a month before the trip they called my daughter in and told her they weren't going to let her go on the trip (and would be keeping my money) if she missed any more classes without a valid reason. There's no way in hell I would have let them steal my money, but that is the type of shit they are doing these days to keep their funding levels up.

The judge stands by his night in jail decision but is going to consider making sure it doesn't show up anywhere so that she isn't penalized in the future. Of course since all of the media has printed her name now, who knows if that would help.

As an employer I would want to hire someone with her drive. A teen supporting others, holding down two jobs and staying on honor roll is what you think should want in an employee.

Yeah it's wrong but this is obviously an isolated incident. The system targets juvie-bound delinquents but in this case it caught a smart girl in a tough situation.

This isn't far from where I live and the girl's boss setup a trust fund for her and people have given $31k so far... http://www.helpdianetran.com/ So maybe she can focus on school.

If I'm not mistaken since she is a minor aren't her records sealed when she turns 18? My nephew is a little piece of garbage and was arrested at least 6 times by the time he was 17. He was told by a counselor from the state that at 18 everything is sealed so he can go into a adulthood with a clean slate.

But it could be one of those things that is different from state to state.

Yes they do " Seal it " but when someone checks it shows as a Juvenile arrest record and it is enough to fuck her life.

I think the rules vary from state to state, but in some states when you search for sealed records it comes back as having no records.

Still, other states, I believe will show that there is a record, but they are sealed. Most juvenile stuff ends up eventually getting destroyed so long as the person maintains a clean record.

As for this girl's case, don't get me wrong. It was fucked up that they put her in jail. I understand arresting her for truancy, but once they heard her story and found out why she was missing class instead of throwing her in jail they should have looked into ways to help her so she can work less and get to school. Especially since she is old enough to drop out or take the GED. They should have been glad she was even going.

All that said, I don't see this as a "ruin her life" kind of thing. If I were her I would leave the record unsealed and wear it like a badge of honor in a job interview. If they ask if you have been convicted of a crime you tell them yes, explain the situation and let them know the reason you were sentenced to one day in jail is because you were trying to go to school while supporting your family. If I am an employer I might look at that say, "This is a person who is dedicated and driven."

It would be different if she were charged with something really bad like theft or assault, but she has a good story, she is getting press now and should save those clippings and make them resume items.

I know what to do - let's put government in charge of EVERYTHING! Then EVERYTHING can be completely fueled up!

You might not see it as a ruin her life kind of things. But Harvard or Yale or MIT might.

Put your kid in her shoes and tell me how you feel about that 1 night now.

I guess we will have to agree to disagree on this. I don't have kids so I can't be in the parent shoe, but I have nieces who I care dearly about and would be pissed off if it happened to them.

Maybe the judge will change his mind and make this go away. That would be the best outcome of all.

If it were me and I was going to apply to Harvard. . . I might be crazy enough to put it on my application. Send along some press clippings and the TV video. Tell them my story right up front. The stories show her to be a kid in a very shitty situation trying her hardest to overcome it and make something good of her life. That is real adversity. That is the kind of person I would want attending my college.

In Texas you can drop out at 17. But obviously that isnt what she wants to do. The truancy laws are there mostly to help curb juvenile delinquency and they cant really pick and choose who they apply to.

I dont like a lot of laws but I dont run around breaking them just because I dont agree with them and think that they shouldnt apply to me.

You do realize that once a person no matter the age has been " Arrested " and spent any amount of time in jail, they will NEVER get that out of their past and it can prevent her from going to the best of Universities and going further in life.

That is a MAJOR fuck up on the part of the judge and the system.

She is working too hard and not attending class. She won't graduate doing that. So the system is on her. Overall I agree with the idea of policing truancy.

Do you think the guy was really staring at some angel or do you think the media has maybe made her out to be a little nicer then she is? Someone is providing some housing. She is working in the family business. Not saying they are wealthy but probably not poor either. It is a wake up call but maybe under the circumstances, her guardians should not have had her working this much.

Look in the mirror and ask yourself that question.

I don't understand why people create negative threads like this about other peoples countries, ANY country.

Clearly you have an agenda using Texas as the touchstone of American society

I am a natural born American citizen who is now ashamed to be an American.

This country has gone straight to hell with our new government leading the way.

We invade and kill thousands of people in other countries based on lies and greed.

We tax our US citizens more and more each time we wake to keep the average American down in poverty.

I could go on and on, but whats the point.

All I know about her situation is from the article and video in it, so this might not be correct. It sounds like her parents got divorced, moved away and now she is working to not just help support herself, but her brother who is in college and a younger brother.

I have no idea how much her natural parents have to do with any of them, but it doesn't sound like they are very involved in their lives.

I didn't know you had compulsory education to 18 in the US - I thought it was 16, the same as here.

I was out the door at 16, I doubt I could have handled another 2 years at that point.

I went back and did another 4 years later and that was the best way for me.

Wow.. I guess you missed the part where I said I am American born and raised and my family roots go all the way back to the Mayflower. It has nothing to do with another country. the US IS my country.

When I was a kid, know what they did if you missed too many days? They'd kick you out of that class, and say, "if you want to graduate, you can take the class over starting next semester".
